SD #23 BLOCKED REGULAR EMPLOYEE STATUS, PENSION & HEALTH BENEFITS
For 2 years and 2 months Fisher was employed by School District #23 as a custodian. When he was hired, SD #23 told him that he would have a full time custodian position called a posting with health benefits in 6 to 12 months.

The School District's promise of a posting in 6-12 months amounts to false representation. SD #23 has refused to turn over the taped recording of that conversation. What makes this false representation even worse is that
SD #23 achieved it using a fraudulent layoff.

SD #23 used 2 different excuses, a fake "need to meet budget requirements" & then on Fisher's ROE a false "shortage of work". A SD #23 official Alan Akehurst Director Of Human Resources admitted in a meeting recorded by SD #23 that it had lied & there was not a shortage of work and not a shortage of money. See page #2 FRAUDULENT LAYOFF for details and a reprint of the conversation that SD #23 recorded and Fisher acquired a copy.

A later paper shuffle included a letter to Fisher that his Benefits would start Nov 1/98. In Oct 98 SD #23 began making deductions from Fisher's pay to cover the cost. After 3 pay period deductions, SD #23 said that the Nov 1/98 benefits start date was a mistake. Fisher contends that this was a binding contract that could not be canceled.

Fisher had started a new posting and the 53 days accumulated of the necessary 65 days probation, according to SD #23 were lost and Fisher would have to start the 65 days of probation over after almost 2 years of being employed.
The collective agreement refers to positions (plural) and never explains that probation can not be in two or more positions doing exactly the same work, in Fisher's case he was always doing the very same custodial duties at each posting.

School District #23 failed to inform Fisher that he would lose his 53 days accumulated if he took the new posting or that he could remain at the previous posting for another 11 days to reach the 65 days and then started the new posting. However, Fisher had already, legally earned regular employee status on July 24/98 with benefits starting Aug 1/98. The School District's FRAUDULENT LAYOFF denied him what he had rightfully earned.
As a footnote, part time workers hired after Fisher had worked for the district nearly 2 years, received benefits after only working 3 months while Fisher had none after 2 years.
SD #23 accepted the necessary documents signed by Fisher in good faith and began making payroll deductions for GROUP LIFE, and PENSION. (shown above) This constituted a legal binding contract which SD #23 broke, leaving Fisher without benefits.
As if the FRAUDULENT LAYOFF wasn't enough, then came the broken benefit contract and the 53 days towards probation lost. The SD #23 PAPER SHUFFLE AFTER FISHER HAD BEEN EMPLOYED FOR 2 YEARS AND 2 MONTHS.

why those layoffs took place.

SD23 The shortage of work is caused by a shortage of money not
because there isn't work to be done.
SD23 So that is why that (shortage of work) would be on the form.
SD23 There isn't something else to say... employer ran out of money
F But you see when the Government looks at this they figure it constitutes fraud.
F There is a place down here (on the form) a comment section which that can be explained.

F But then they hired on the next day which means there was funds (money).
