SCHOOL DISTRICT #23 MALFEASANCE
OVERSIZE AREA
Below is the Nov 6/98 letter to Buckley from SD #23 Johnson in response to Fisher's square foot calculations of his area to clean.
In the NOV 6/98 letter Johnson states that SD #23 requires 18, 200 square feet to be cleaned during an 8 hour shift. Johnson points out that the area Fisher cleaned was oversize some 2,000 to 3,000 square feet. Johnson gave Buckley suggestions on how to bring the Fisher area into line with the 18, 200 foot requirement. Buckley did not follow Johnson's suggestions nor did Buckley act immediately to rectify the burden of the oversize area on Fisher. Buckley let Fisher swelter under that burden for another 3 long months during which she assigned extra help to the Head Custodian's area to clean and authorized him to download his work onto Fisher.

At the same time Fisher was coming under the constant abuse and harassment of the Head Custodian who was delaying & lying about ordering supplies and equipment that Fisher required to do his job. Fisher had to go to another school to borrow supplies and he was forced to bring in and use his personal mop bucket and wringer. Fisher contacted the union custodial shop steward to talk with the Head Custodian about these matters of delaying & lying about ordering supplies, downloading work and on the job harassment.

When the school got extra custodial workers, Buckley instructed them to work on the Head Custodian's area, not on Fisher's area. Buckley justified that by saying, Fisher had been off sick for 4 weeks and that the Head Custodian had to take up the slack. Buckley mistakenly failed to take into account that the Head Custodian had been off sick for almost 4 weeks, left early many days and did little or nothing on professional days, while Fisher with the oversize area, worked hard on professional days & had to take up the slack during the Head Custodian's many absences, yet Fisher did not get any extra help. Again it doesn't appear that Buckley was in touch with reality.

Please note in Fisher's footage calculations on page 4 the average for the 12 schools was 12.45 rooms and 3.67 washrooms to be cleaned by the evening custodian while the area that Fisher had to clean included 18 rooms and 5 washrooms, clearly out of proportion to all 12 other schools. Johnson's letter confirmed Fisher's calculations. Yet Buckley sat on it, didn't act until 3 months after receiving the Nov 6/98 Johnson letter.
            Buckley & SD #23 were guilty of stealing time from Fisher.

Eventually the need to clean the oversize area took a heavy toll on Fisher's health. Court decisions find that when an employer knowingly maintains work conditions marked by chronic understaffing & an employee's health deteriorates as a result, the employer SD #23 is liable for damages.

SD #23's claims against Fisher are groundless & fabricated. SD #23 colluded & conspired to discredit Fisher.
